TOWN OF CLEAR LAKE
REGULAR COUNCIL MEETING

JULY 14, 2003

Present: Robert Troll, President, Town Council; Derold Covell, Council Member, Virginia Nye, Clerk Treasurer, Richard Lehman, Marshal, Don Stuckey, Town Attorney, Mark Sullivan, Commonwealth Engineers. Forty two visitors signed the guest register.

The Town Council President called the meeting to order at 7:00 p.m.

The clerk read the minutes of the June 9, 2003 Regular Council meeting. Derold Covell made the motion that the minutes be approved as read, Robert Troll seconded, and the motion passed. The financials included the following. The on-hand balances as of June 30 were as follows: General Fund balance $834,044.61; the Garbage Fund balance was $79,009.07, Certificate of Deposit Balance $95,572.95. The Sewer Escrow Account is presently $169,146.27. The Wastewater Works Project Loan Budget total is $3,520,000. The Project Costs that are paid to date are $3,439,820, leaving a balance of $80,180. Of the $500,000 Grant, disbursements total $258,914, leaving a grant balance of $241,086. Derold Covell moved approval, Robert Troll seconded, and the motion passed. The Accounts Payable Voucher Register was available for all to read.

The Marshal’s report for the period June 9 to July 14, 2003 was read by Marshal Lehman. Derold Covell moved approval, Robert Troll seconded, and the motion passed.

OLD BUSINESS

Mark Sullivan introduced the following vouchers for approval by the Council:

Voucher 44 $14,072 Inspection
Voucher 45 $ 4,131 Construction Engineering
Voucher 46 $ 456 Startup
Voucher 47 $ 924 Legal

Derold Covell moved approval, Bob Troll seconded, and the motion passed.

Mark Sullivan reported on the progress of the sewer project: main line test is being done as fast as they can and he hopes to be able to start up all 404 pumps the first or second week of August.

Bob Troll introduced the town vouchers that require approval. They are:

8820 Midwest Billing Administrators $650.00
8828 Crawford Excavating, Inc. $534.00
8829 Virginia Nye $486.38

Derold Covell moved approval, Bob Troll seconded, and the motion passed.

The Council proposed the annual fire protection contract between the town of Clear Lake and the Fremont Volunteer Fire Department for approval. The contract shall be binding for the year 2004 for the total sum of $17,303. Derold Covell made the motion for approval of the contract, Bob Troll seconded, and the motion passed.

The Council will repair and chip and seal potholes on Thursday. Any help will be appreciated.

NEW BUSINESS

An Ordinance Amending Building Regulations and the Subdivision Control Ordinance of the Town of Clear Lake (Ordinance 287) as proposed by the Clear Lake Plan Commission, was introduced for approval by the Town Council. Bob Troll then read the proposed ordinance. After discussion, Derold Covell made the motion that Ordinance 287 be approved as read, Bob Troll seconded, and the motion passed.

For the second reading of Ordinance 287 (An Ordinance Amending Building Regulations and the Subdivision Control Ordinance of the Town of Clear Lake), Derold Covell moved that the Council suspend the rules and read by title only, Bob Troll seconded, and the motion passed. Motion to approve the second reading of Ordinance 287 was made by Derold Covell, seconded by Bob Troll, and the motion passed.

Ordinance 287, third reading. Motion was made to dispense with the rules and read Ordinance 287 by title only by Derold Covell , seconded by Bob Troll, and the motion carried. A motion was made by Derold Covell to approve Ordinance 287, seconded by Bob Troll, and the motion passed.

The last item of new business was a resolution to change CEDIT to include 10 percent of the funds for Economic Development Director for the County. Derold Covell made the motion to approve the Resolution to Change CEDIT Tax Distribution, Bob Troll seconded, and the motion passed.

With no additional new business, the Council meeting was adjourned at 8:35 p.m. Derold Covell moved approval, Bob Troll seconded, and the motion passed.
