TOWN OF CLEAR LAKE
REGULAR COUNCIL MEETING

December 8, 2003

The December 8, 2003 Town Council meeting at St. Paul Chapel was called to order at 7:00 p.m. by Robert Troll, President.  Also present were Derold Covell, Council Member, Emma Brown, Council Member, Virginia Nye, Clerk Treasurer, Richard Lehman, Marshal, Mark Sullivan and Mark Field, Commonwealth Engineers, and Donald Stuckey, Town Attorney.  Thirty-four visitors signed the guest register.

The clerk read the minutes of the November 10 Council meeting.

The clerk gave the financial report for the period November 1 - November 30.  The financials included the following balances:

General Funds Balance             $1,035,850.50
Garbage Fund Balance             $     76,220.00
Sewer Escrow Balance             $   169,848.30
Certificates of Deposit              $     96,291.95

The Wastewater Works Project Loan Budget of $3,520,000 with charges of $16,098 leaves a balance of $16,191.  The $500,000 State Grant has total expenses of 276,006 leaving a balance of $223,994.

Emma Brown moved approval of minutes and financials as read, Derold Covell second and the motion passed.

Dick Lehman gave the marshal’s report for the period November 10 to December 8.  Emma Brown moved approval, Derold Covell second and the motion was approved.

David Gardiner, the Zoning Inspector, gave the zoning report.  There will be a BZA meeting on December 15.  Emma Brown moved approval, Derold Covell second that the report be accepted as read, and the motion passed.

OLD BUSINESS

Mark Sullivan reported on the progress of the sewer system.  The entire system around the lake and into Fremont has passed inspection.  The system including the generator has all been started up.  The Council and Mark Sullivan have met with Fremont.  Mark Field is working on the house to house punch list.  The surface restoration will be done next spring.  With the creation of the punch list the project will have substantial completion.  With substantial completion the town will be able to start the permitting process for homeowners to connect.

Mark Sullivan introduced the following claims for the sewer:

1)  Town of Fremont, Connection fee         $86,400.00
2)  Contractor, for work completed            $36,167.09
      (for work completed, approve & hold for retainage)

Emma Brown moved approval, Derold Covell second and the vouchers were approved.

The following vouchers were introduced for approval by Bob Troll:

Derold Covell moved approval, Emma Brown second, and the motion passed.

NEW BUSINESS

Don Stuckey introduced and read Ordinance 295, an ordinance to disallow discharge of a rifle, bow and arrow, or other firearm within the town limits.  The ordinance allows a $500 fine for violation of the ordinance.  This will be effective upon the second and third readings and passing and publication of the proposed ordinance.  Emma Brown made the motion to approve the ordinance on first reading, Derold Covell second, and the motion passed.  The ordinance will be read two more times.

Resolution 12-8-03 - 1, to establish a Sewer Connection Permits Account, was introduced.  Derold Covell moved approval, Emma Brown second, and the motion carried.

At 7:37 p.m., there being no additional new business, Emma Brown made the motion to adjourn, Derold Covell second and the motion carried.
