The January 12, 2004 Town Council meeting at St. Paul’s Chapel was called to
order at 7:00 p.m. by Robert Troll, President. Also present were Derold Covell,
Council Member, Teresa Gardiner, Clerk Treasurer, Richard Lehman, Marshal, Dave
Gardiner Zoning Inspector, Mark Sullivan, Commonwealth Engineers, And Donald
Stuckey, and Town Attorney. Twenty-two guests signed the guest register.
The clerk read the minutes of the December 8, Council meeting. Derold Covell
made a motion to approve the minutes and place on file. Robert Troll seconded
approval. Motion carried.
The clerk gave the financial report for the period December 1-January 1. The
financials included the following balances.
General Funds Balance $ 913,226.10
Garbage Fund Balance $ 71,090.42
Sewer Escrow Balance $ 170,001.86
Certificates of Deposit $ 96,291.95
The Wastewater Works Project Loan Budget of $3,520,000 had no charges last month
continues with a balance of $16,191. The $500,000 State Grant has total expenses
of $318, 309 leaving a balance of $181,691.
Derold Covell made a motion to approve the financial report and place on file.
Seconded by Robert Troll. Motion carried.
Dick Lehman gave the marshal’s report for the period December 8, till January
12. Derold Covell moved approval. Robert Troll seconded approval. Motion
carried.
David Gardiner, the Zoning Inspector, gave the zoning report. Derold Covell
moved for approval. Seconded by Robert Troll. Motion carried.
Old Business
Robert Troll read a letter in response to Emma Brown’s resignation as Council
Member.
Election of Officers
Derold Covell nominated Robert Troll as President Nomination was closed. Robert
Troll was elected.
Robert Troll nominated Derold Covell as Vice President. Nomination was closed.
Derold Covell was elected.
Mark Sullivan reported that in regards to the sewer system progress: Currently
they are completing individual grinders; now the focus will be the mainline
punch list. Mark stated that air-testing was not going to be done; also he
addressed the issue of a homeowner connecting their own generator to a public
utility could pose to be a liability issue.

Derold Covell moved that the vouchers be approved. Seconded by Robert Troll.
Motion carried.
Ordinance 295, second reading. Motion to suspend the rules and read Ordinance
295 by title only was made by Robert Troll. Motion passed. Motion to approve
Ordinance 295 on second reading was made by Derold Covell. Seconded by Robert
Troll. Motion Carried.
New Business
Resolution 01/12/04 (Resolution to Transfer Funds) was introduced by Robert.
Troll Motion by Derold Covell was made to pass the resolution. Seconded by
Robert Troll. Motion carried.
Robert Troll introduced the appointment of Dave Gardiner, as the
clerk-treasurer’s deputy.
Robert Troll introduced a contract with St. Paul’s Chapel. Usage of the chapel
to hold town meetings will be $100.00. per meeting. Motion to approve contract
was made by Derold Covell. Seconded by Robert Troll. Motion carried.
Unit #2 Sailors Cove; grinder needs to be removed; cost needs to be eliminated.
Motion was made by Derold Covell for approval. Seconded by Robert Troll. Motion
carried.
Unit # 5 Property location 1008 Lake Dr. Property Owner, Imogene Young
Requesting to pay ½ fees for sewer at 1008 Lake Drive.
Derold Covell made a motion for approval . Seconded by Robert Troll. Motion
carried.
Zoning & Ordinance change. Paul Federspiel proposed a clarification in regards
to creating definitions.
Clear Lake Planning Commission, which met at a public meeting, Jan. 5, made
recommendations for changes in the Clear Lake Code of Zoning Ordinances.
These changes will be know as Ordinance Number 296, and is on file at the Town
Hall.
Motion by Derold Covell to approve Ordinance Number 296 on the First reading.
Seconded by Robert Troll, Motion Carried
Dave Gardiner proposed that the old computers from the Town Hall be donated to
Fremont Schools. Attorney, Donald Stuckey stated that they would have a value no
more than $100.00. Derold Covell made a motion for approval. Motion was seconded
by Robert Troll. Motion carried.
David Gardiner, Zoning Inspector, stated that Steuben County Health Department
will not allow anyone to build until they are connected to the sewer.
Dave Gardiner, proposed no connection permits be issued to anyone in arrears
with the billings. Derold Covell made a motion to approve. Seconded by Robert
Troll. Motion Carried.
Adjournment
At 8:15 p.m., there being no additional new business, Derold Covell made the
motion to adjourn. Seconded by Robert Troll. Motion carried.
