The Feb 9, 2004 Town Council meeting at St. Paul’s Chapel was called to order
at 7:00 p.m. by Robert Troll, President. Also present were Derold Covell,
Council Member, Jack McArdle, Council Member, Teresa Gardiner, Clerk Treasurer,
Richard Lehman, Town Marshall, David Gardiner, Zoning Inspector, and Donald
Stuckey, Town Attorney. Thirty-six guests signed the guest register.
President Robert Troll introduced Jack McArdle as the new second ward council
member.
The clerk read the minutes of the January 12, council meeting. Jack McArdle
noted a correction to be made to the minutes; ( Page 3, Paragraph 5, the last
sentence be omitted in reference to The Planning Commission public meeting due
to being repetitive in the next paragraph.
Jack McArdle made a motion for approval of the minutes, with corrections and be
placed on file. Seconded by Derold Covell. Motion carried.
The clerk gave the financial report for the period, January 1- January 31. The
financials included the following balances:
General Funds Balance $954,673.86
Garbage Fund Balance $ 66,300.14
Sewer Escrow Balance $170,141.59
Certificates of Deposit $ 96,525.56
The Wastewater Works Project Loan Budget of $3,520.000 with charges of $16,098
leaves of a balance of $16,1l1. The $500,00 State Grant has total expenses of
$276,006 leaving a balance of $223,994.
Derold Covell made a motion for approval of the financial report. Seconded by
Jack McArdle. Motion carried.
Dick Lehman gave the marshal’s report for the period, January 12 to February 9.
Derold Covell moved for approval, Jack McArdle seconded. Motion carried.
David Gardiner gave the zoning report. Derold Covell moved for approval.
Seconded by Jack McArdle. Motion carried.
Old Business
Mr. Joe Poffenberger, general manager of Mediacom Communications Corporation
gave a presentation as to how his cable company could benefit the Town Of Clear
Lake.
The following vouchers were introduced for approval:

#9066 M & C Trenching $1,553.75
#9067 M & C Trenching $3,007.50
#9068 Teresa Gardiner $ 324.29
Jack McArdle moved for approval. Seconded by Derold Covell. Motion carried.
Robert Troll reported that the town is still pursuing liability insurance.
Property Owner 950 Lake Dr.,Tom Echrich , asked if the lack of liability
insurance would impact the continuity as a town. Donald Stuckey, Town Attorney,
reported that Clear Lake is still a town; we still have elected officials and a
government. The lack of liability insurance just means that the elected
officials are serving in limited capacity. Issues will be reviewed as a case by
case basis to determine whether it is appropriate to move forward. He also
stated that the town will be issuing sewer connection permits, and basic
building permits. In regards to building permits; No permits will be issued
until an evaluation has been done and deemed appropriate to move forward.
Applications will still be available at the Town Hall.
A trial report written by Bruce Kamplain, Attorney for Tudor Insurance, was read
by Robert Troll.
Robert Troll read Ordinance 297 (Vacating portions of the platted roadway in
McLoth’s Plat, in which it will be titled to Mr. & Mrs. Dietrich.) Derold Covell
moved approval of the first, reading, Jack McArdle seconded, and motion passed.
Ordinance 297, second reading A motion to dispense with rules and read by title
only was made by Derold Covell. Seconded by Jack McArdle. Derold Covell moved
for approval of the second reading, Jack McArdle seconded. Motion carried.
Ordinance 297, third reading. Motion to dispense with rules and read by title
only was made by Derold Covell., seconded by Jack McArdle. Motion carried. Jack
McArdle moved approval of the third reading, Derold Covell seconded, and the
motion carried.
New Business
The next council meeting will be March 8, 2004.
At 8:20 p.m., there being no additional new business, Jack McArdle made a motion
to adjourn. Derold Covell seconded and motion carried.
