TOWN OF CLEAR LAKE
MEETING MINUTES

June 14, 2004

The June 14, 2004 Town Council meeting at St. Paul’s Chapel was called to order at 7:00 p.m. by Robert Troll, President. Also present were Derold Covell, Council Member, Jack McArdle, Council Member, Teresa Gardiner, Clerk Treasurer, Richard Lehman, Town Marshall, David Gardiner, Zoning Inspector, and Donald Stuckey, Town Attorney. Thirty guests signed the guest register.

The clerk read the minutes of May 10, council meeting and the special meeting of April 21, (Proposal of installation of Powhattan Lane Street.) Derold Covell made a motion for approval of the minutes with corrections and be placed on file. Seconded by Jack McArdle. Motion carried.

The clerk gave the financial report for the period, May 1-June 10. The financials included the following balances:
General Funds Balance $442,449.34
Sewer Balance $673,593.13
Garbage Fund Balance $ 42,836.85
Sewer Escrow Balance $170,696.97
Certificates of Deposit $ 97,008.91

Jack McArdle made a motion for approval of the financial report and be placed on file. Seconded Derold Covell. Motion carried.

Dick Lehman gave the marshal’s report for the period, May 10, to June 14. Derold Covell moved for approval and be placed on file. Jack McArdle seconded the motion. Motion carried.

David Gardiner, Zoning Inspector, gave the zoning report. Report placed on file.

Old Business

Don Stuckey, Town Attorney, reported that Geiger Excavating has filed a suit against the town and Commonwealth Engineering for not issuing their last request for payment. The town is filing a countersuit for liquidated damages and completion of work which violates their contract.


Voucher Approval for the June 14 meeting (See Attached) Jack McArdle moved for approval and is placed on file. Seconded by Derold Covell. Motion carried.

Ordinance 299; Third Reading, (Privately Owned Generator Hook-ups) Robert Troll read the ordinance in it’s entirety. Derold Covell made a motion to approve and place on file. Seconded by Jack McArdle. Ordinance 299 was adopted.

New Business

Resolution 6/14/04 (Transfer of funds) Derold Covell made a motion for approval and be placed on file. Seconded by Jack McArdle. Motion carried.

Ordinance 300, (Miscellaneous Compensation; office of Clerk Treasurer) The clerk read the ordinance in it’s entirety. Motion to approve the ordinance on the first reading was made by Derold Covell. Seconded by Jack McArdle. Motion carried. Motion to suspend the rules and read by title only for the second reading was made by Derold Covell.. Seconded by Jack McArdle. Derold Covell moved for approval. Approval seconded by Jack McArdle. Motion carried. Motion to suspend the rules and read by title only for the third reading was made by Jack McArdle. Seconded by Derold Covell. Motion carried. Motion to approve on the third reading and be placed on file was made by Jack McArdle. Approval was seconded by Derold Covell. Motion carried. Ordinance 300 was adopted.

Robert Troll appointed Tom Reith, Bill Geiger and Dave Gardiner to the building committee.

A motion to approve the purchase of three barricades was presented by Robert Troll. Motion to approve the purchase was made by Derold Covell. Seconded by Jack McArdle. Motion carried.

The council meeting will reconvene Tuesday, June 15 at 6:30 at the town hall.
The budget estimate for 2005 was discussed.

At 10:25 p.m. there being no additional business a motion to adjourn was made by Jack McArdle. Seconded by Derold Covell. Motion carried.
