The August 9, 2004 Town Council meeting at St. Paul’s Chapel was called to
order at 7:00 p.m. by Robert Troll, President. Also present were Derold Covell,
Council Member, Jack McArdle, Council Member, Virginia Nye, and Donald Stuckey,
Town Attorney. Forty five guests signed the guest register.
Bob Troll read the minutes of the July 12, 2004 meeting followed by the vouchers
approval for the July meeting. Jack McArdle made the motion to approve the
minutes and Derold Covell seconded. Motion carried.
A contract was signed with H. J. Umbaugh and Associates to complete the Town
budget preparation and to advertise in the local newspaper by August 13.
Since the Marshal was on vacation, Bob Troll read the Marshal’s report for the
period, July 12 to August 2. Derold Covell moved approval and Jack McArdle
seconded and the motion carried.
Old Business:
Mark Sullivan was in Chicago, therefore, did not give a sewer report. Bob
reported that 294 sewers are hooked up. Permits for 59 additional hook ups have
been issued, but not completed. In addition, there are 4 problem grinders to be
hooked up.
Don Stuckey, Town Attorney, reported on the town lawsuits. In the Hoagland
lawsuits, the original appeal has been dismissed. In the federal lawsuit, Dan
Palmer reported that he has filed a summary judgment and hopes that it will be
heard within 30 to 60 days.
The sewer case with Geiger is in the discovery phase. We are working with the
bonding company. Since Brooks Construction has not been paid by Geiger, Don
Stuckey feels that this strengthens our position.
At the Board of Zoning Appeals meeting of July 26, seven variances were heard
and two variances were approved.
Pending the selection of a zoning inspector, there will be no building permits
issued. However, sewer connection permits will be issued.
The attached list of warrants was approved by the Council. McArdle moved
approval, Derold Covell seconded, and the motion passed.
NEW BUSINESS
Bob Troll introduced a contract with H. J. Umbaugh and Associates to complete,
with a maximum $4,500 charge, the 2005 budget. Derold Covell moved approval,
Jack McArdle seconded, and the motion carried.
It was announced that the new Town Council member from Ward 1 will be Anthony
Kraus, 112 Lake Drive. The Council member from Ward 3 has not yet been approved.
Budget meeting of the Steuben County Economic Council for the 2005 fiscal year
was held. The Town of Clear Lake share of the $8,838 budget will be 14.5% (or
$1,282) to be used to finance the Council. Jack McArdle moved approval, second
by Derold Covell, and the motion passed.
Bob Troll reminded everyone of the Saturday, September 4 heavy trash pickup.
Next meeting will be September 13.
Bob Troll announced that the current council needs to elect a new Town Council
president. Derold Covell made the motion to nominate Jack McArdle as president,
Bob Troll seconded, and the motion passed.
Bob Troll received the thanks and a standing ovation from the audience for all
his service to the Town of Clear Lake during his years on the Town Council and
as Council President.
At 7:50 p.m. Jack McArdle made a motion to close the meeting, Derold Covell
seconded and the motion carried.
