Minutes of the December 13, 2004 Town Council Meeting
The December 13 regular meeting of the Clear Lake Town Council was called to
order at 7/02 p.m. by President Jack McArdle. Present were: Jack McArdle,
Council President, Larry Armstrong, Councilman, Anthony Kraus, Councilman,
Donald Stuckey, Town Attorney, Bruce Snyder, Zoning Inspector, Virginia Nye,
Clerk, and 24 guests.
Minutes of the November 9 meeting were read by Virginia Nye. Tony Kraus noted a
correction in the minutes. Larry Armstrong moved that the minutes be approved as
corrected. Anthony Kraus seconded and the motion passed.
The Financial Report through November 30 was read by the Clerk. Larry Armstrong
moved approval, Tony Kraus seconded and the motion was passed. The Voucher
register was also available for anyone to read.
The Marshal’s report for the period November 8 to December 13 was read by Larry
Armstrong. Anthony Kraus moved approval, Larry Armstrong seconded, and the
motion passed.
The Zoning Inspector’s Report was given by Bruce Snyder. He announced that there
will be a BZA meeting on December 18, 2004. Larry Armstrong moved approval, Tony
Kraus seconded, and the motion passed.
OLD BUSINESS
Donald Stuckey reported, regarding the Geiger lawsuit, that the Bonding Company
has made a request for additional documents, which were sent. He also reported
that there was no activity on the Hoagland lawsuits, nothing in State Court and
nothing additional has been filed. He did mention that Hoagland had filed a Tort
Claim Notification relative to the easement on the Nevins property.
Jack McArdle gave the Ordinance 302, a motion to vacate in the McLouth
subdivision, a second reading. Tony Kraus moved approval of this second reading,
Larry Armstrong seconded, and the motion passed.
NEW BUSINESS
Larry Armstrong introduced an ordinance to create a position of Town
Superintendent, on a part-time basis, to manage the Town work on sewer, streets,
drainage ditches, etc. There was a short discussion of the idea. Jack McArdle
read Ordinance 303 which would create a Town Superintendent position. Tony Kraus
moved approval, Larry Armstrong seconded, and the motion passed.
Second reading of Ordinance 303. Larry Armstrong moved that the rules be
suspended so the ordinance could be read by title only. Anthony Kraus seconded
and the motion passed. Jack McArdle gave the second reading of Ordinance 303 by
title only. Larry Armstrong moved approval of the second reading, Tony Kraus
seconded, and the motion passed.
Third reading of Ordinance 303. Larry Armstrong moved that the rules be
suspended so the ordinance could be read by title only. Anthony Kraus seconded
and the motion passed. Jack McArdle gave the third reading of Ordinance 303 by
title only. Tony Kraus moved approval of the third reading, Larry Armstrong
seconded, and the motion passed.
Ordinance 304 (Salary Ordinance for the year 2005). First Reading. The Salary
Ordinance was read by Jack McArdle. Tony Kraus made the motion that the
ordinance be approved as read. Larry Armstrong seconded, and the motion passed.
Second reading of Ordinance 304. Larry Armstrong moved that the rules be
suspended so the ordinance could be read by title only. Tony Kraus seconded, and
the motion passed. Jack McArdle gave the second reading of Ordinance 304 by
title only. Larry Armstrong moved approval of the second reading. Tony Kraus
seconded, and the motion passed.
Third reading of Ordinance 304. Larry moved that the rules be suspended so the
ordinance could be read by title only. Anthony Kraus seconded and the motion
passed. Jack McArdle gave the third reading of Ordinance 304 by title only. Tony
Kraus moved approval of the third reading. Larry Armstrong seconded, and the
motion passed.
The Town Council opened three bids on the Garbage Collection Contract for the
three years of 2005, 2006, and 2007. The companies bidding were Borden Wastaway
Services, Inc., TriState Waste Services and Republic Services. The Town Council
will meet at the Clear Lake Town Hall at 6:00 p.m. on Monday, December 20, 2004
to accept the appropriate bid.
Larry Armstrong made a motion to continue the Town’s association with the
Steuben County Economic Development Corporation for the year 2005. He also moved
that Bob Troll continue as the liaison with the organization. Tony Kraus
seconded, and the motion passed.
Tony Kraus moved that the meeting adjourn at 8:20 p.m. Larry Armstrong seconded,
and the motion passed.

Resolution 12/13/04
CONNECTION PERMITS FOR NEW SEWER HOOKUPS AFTER JANUARY 1, 2005
Beginning January 1, 2005, the cost for connection permits will be $200.
1) Motion, effective January 1, 2005, those not on list of connected and/or
permit in hand , the cost for Connection Permits will be $200.
2) Only those cases where exception has been granted by the Council, when there
has been cause for delay for construction reasons, will the cost be $100 for
permit to connect.

Special Meeting of the Clear Lake Town Council
December 20, 2004
6:00 p.m.
A special meeting of the Clear Lake Town Council was called for the purpose of a
decision for a new garbage contract for the years 2005-2007.
Anthony Kraus called the meeting to order at 6:07 p.m. Present were Anthony
Kraus, Larry Armstrong, and Virginia Nye.
The purpose of the meeting was to decide on the garbage contract. There were
three bids. The bids included information on a possible increase in 2006.

Republic Waste Services 6.99 7.14 per unit
TriState Waste Services 5.23 5.26 per unit
Borden Waste-Away Services 7.62 7.88 per unit
Larry Armstrong made a motion to accept the bid of TriState Waste Services, Tony
Kraus seconded, and the motion carried.
At 6:30 p.m. Larry Armstrong made a motion to adjourn the meeting, Tony Kraus
seconded, and the motion carried.

Open and Executive Meeting
December 29, 2004
6:00 p.m.
The Town Council held a public meeting on December 29, 2004 for the purpose of
interviews for Clear Lake Town Superintendent. Present were Jack McArdle, Larry
Armstrong, and Virginia Nye.
Jack McArdle called the meeting to order at 6:08 p.m. He announced that the
interviews would be held in open meeting, the Council would then meet in
Executive Session, and the announcement of their decision would follow in open
meeting.
Jack McArdle and Larry Armstrong interviewed the two candidates. The two people
to be interviewed were Richard A. Lehman and Robert Hull.
The interview with Richard Lehman was followed by the interview with Robert
Hull.
The Town Council retired for an executive meeting to discuss the interviews and
then returned to public session.
Larry Armstrong made a motion to do a background check, and to offer the
position to Robert Hull. Jack McArdle seconded and both council members voted
AYE.
The meeting was adjourned at 7:45 p.m.
