Minutes of the February 14, 2005 Town Council Meeting
The February 14, 2005 Town Council Meeting was called to order at 7:15 p.m. by
President Jack McArdle. Present were: Jack McArdle, President; Anthony Kraus,
Councilman, Donald Stuckey, Town Attorney; Virginia Nye, Clerk-Treasurer; Bruce
Snyder, Zoning Inspector, and Robert Hull, Town Superintendent. And 23 people
signed the guest register.
Prior to reading the minutes of the January 10 meeting, Don Stuckey discussed
the ramifications involved in not reading the entire minutes at each meeting.
Anthony Kraus made the motion to suspend the reading of the entire minutes
because the minutes would be available on the Town’s web-site and individual
copies of the minutes would be available at the meeting. President McArdle
seconded and the motion passed.
Following this, Jack McArdle read the minutes of the January 10, 2005 Town
Council Meeting. Anthony Kraus moved approval, McArdle seconded, and the motion
passed.
The Financial report for the year 2004 was read by the Clerk-Treasurer. Anthony
Kraus moved that the report be approved and attached to the minutes of the
meeting. Jack McArdle seconded and the motion passed.
Anthony Kraus submitted a list of warrants and moved that they be approved and
paid. Jack McArdle seconded and the motion passed.
Tony Kraus read the Marshal’s report and made a motion to accept the report as
read. Jack McArdle seconded and the motion passed.
The Zoning Inspector’s report was read by Bruce Snyder. A highlight of this
report was the growing concern about having structures in addition to the home
structure being given a number. This would mean that, in the event of an
emergency situation, the EMS people would know precisely where to go to respond
to the emergency call. Structures in Penner Acres and the Powhatton subdivision
will also be given numbers. Anthony Krause moved that the report be approved,
Jack McArdle seconded and the motion passed.
The Town Superintendent report was read by Bob Hull. Highlights were 1) the Town
is now on a notification system (Holy Moly) regarding underground utilities.
Therefore, before any excavation is undertaken around the lake, the Town needs
to be notified.
2) The Town Hall building committee met and decided to begin work on the new
Town Hall in September. This summer the foundation will have to be installed. 3)
The Town truck will be identified by a sign on the doors. 4) He noted that there
have been reports of brush over the roadway on 850E between Outer Drive and Lake
Drive. He will get quotes to correct this and report back to the Council.
Old Business
The Plan Commission was made aware of the possible confusion about some street
names in Penner Acres. The Town Council passed Resolution # 2005-3 which would
clarify the issue. The Resolution changes the names of John Street, Joann
Street, Penny Place, and Powhattan Lane to John Court, Joann Court, Penny Court
and Powhattan Court. It was felt that this change would alert Emergency
personnel that these areas are cul-de-sacs and not streets. This change is to be
effective February 14, 2005. Tony Kraus made a motion to accept the name
changes, Jack McArdle seconded, and the motion passed.
Don Stuckey stated that the Hoagland lawsuit was in the discovery stage.
New Business
The Plan Commission gave the Town Council three pass recommendations from its
recent meeting. These recommendations referred to 1) Demolition of Buildings and
Structures, 2) Size and height of private garages, and 3) Height and rooflines
of houses. Approval of recommendations 1 and 2 were put into Ordinance #305.
Recommendation 3 was referred back to the Plan Commission.
The first two recommendations were combined into one ordinance, Ordinance #305,
and was read by Jack McArdle. Tony Kraus made a motion to accept the first
reading of Ordinance 305 as read and corrected. Jack McArdle seconded and the
motion passed.
Robert Hine raised the question about water across the road in three or four
spots.
Mike Long said that Verizon now has DSL available to some of the homes in Clear
Lake. The cost is $30.00 a month and requires a one year commitment.
At 8:10 p.m. Tony Kraus made the motion to adjourn, Jack McArdle seconded and
the motion passed.
