Minutes of the April 11, 2005 Town Council Meeting
The April 11, 2005 Town Council Meeting was called to order at 7:08 p.m. by
President Jack McArdle. Present were: Jack McArdle, President; Anthony Kraus,
Councilman, Larry Armstrong, Councilman, Donald Stuckey, Town Attorney; Virginia
Nye, Clerk Treasurer; Bruce Snyder, Zoning Inspector; and Robert Hull, Town
Superintendent. Twenty-one people signed the guest register.
Jack McArdle reviewed the minutes of the March 14, 2005 Council Meeting. Larry
Armstrong moved approval of the minutes, seconded by Tony Kraus, and the motion
passed. The March minutes are available on the Town of Clear Lake website.
The financial reports for both February and March were given by Virginia Nye.
The Voucher Register for March and warrants greater than $250 were also noted.
Tony Kraus made the motion to approve the financial reports, the voucher
register, and warrants greater that $250, seconded by Larry Armstrong, and the
motion passed.
Larry Armstrong gave the Marshal’s report. He also reported that the town has
been working with the county to coordinate the firing of the sirens in case of
weather emergencies. The town would also be able to set off the sirens in case
of local emergency. The plan will be to test the sirens on the first Friday of
the month at noon weather permitting.
Bruce Snyder gave the Zoning and Building Report. Three Improvement Location
Permits were issued in the March to April period. There was a meeting of the
Board of Zoning Appeals on March 28. Four requests for variances were heard.
Larry Armstrong moved approval of the Marshal Report and the Zoning and Building
Report, Tony Kraus seconded, and both reports were approved.
Don Stuckey reported on the federal lawsuit. This is a time of organizing
depositions, strategy, and layout of the time frame. He also said that the town
has received a tort claim notice of past and present claims.
Bob Hull gave the Town Superintendent report. The new street signs are now
installed at Penn Acres Subdivision. The brush has been removed from both sides
of CR 850 E. The drainage problem at 331 Lake Drive has been resolved with the
help of Larry Gilbert and the Steuben County Surveyor Office. He has also put
down 8 tons of cold patch to fill pot holes.
Bob asked for input of strategy to improve the roads around the lake. Discussion
included road damage done during the sewer installation that has not been
corrected, approve a portion of the road for repair each year, repair roads to
the extent of the MVH budget, repair the worst areas this year and do a bond
issue and spend the balance of the budget for engineering fees and a rate study.
More information will be available at the next meeting.
Ordinance 305, third reading. Jack McArdle noted that Ordinance No. 305 included
150.41 Demolition of Buildings and Structures, and Private Garage – 154.046
Height Requirements. Tony Kraus made the motion to read the ordinance by title
only, seconded by Larry Armstrong, and the motion passed. Tony Kraus then made
the motion to approve the third reading of the ordinance, seconded by Larry
Armstrong, and the motion was approved.
Ordinance 306, first reading. Jack McArdle read the proposed ordinance entitled
Economic Development Income Tax Capital Improvement Plan for Clear Lake,
Indiana. Ninety percent of the revenues received will be used for repair,
resurfacing, and upgrading roads. Ten percent of the CEDIT revenues will be
contributed to the Steuben County Economic Development Commission. Tony Kraus
made a motion to approve the first reading of the ordinance, seconded by Larry
Armstrong, and the motion carried.
Larry Armstrong discussed the 2005 Fire Contract with the town of Fremont. The
cost to the Town of Clear Lake will be $17,822 for 2005. Larry made a motion to
approve the contract, Tony Kraus seconded and the motion carried
At 8:05 p.m. Tony Kraus made the motion to adjourn, Larry Armstrong seconded,
and the motion passed.
