Minutes of the August 8, 2005 Town Council Meeting

The August 8, 2005 Town Council Meeting was called to order at 7:05 p.m. by Jack McArdle, President. Present were: Jack McArdle, Larry Armstrong, Councilman; Anthony Kraus, Councilman; Donald Stuckey, Town Attorney; Virginia Nye, Clerk Treasurer; Richard Lehman, Marshal; Bruce Snyder, Zoning Inspector; and Robert Hull, Town Superintendent. Forty-eight people signed the guest register.

The minutes of the July 11, 2005 Council Meeting were read by Virginia Nye. Tony Kraus moved approval (with corrections), Jack McArdle seconded, and the motion carried.

The financial report was given by Virginia Nye. The balances for July 2005 are as follows:

General Fund Accounts $558,449.92
Garbage Account $121,276.03
Sewage Utility $860,589.51
Build Indiana CDs $ 63,427.70

Dick Lehman gave the Marshal’s report for the period, July 11 – August 8. This was followed by Larry Armstrong with the Fremont Fire Department report.

Bruce Snyder, Zoning Inspector, reported that he issued one Improvement Location Permit and one demolition permit in the July-August period. He also discussed updating the plat book including the Clear Lake Corporate limits. The county now has the capability of reproducing the plat book. The town would require 54 pages at $2.00 per page, making a total of $108 for the required pages. The Council gave authorization to use general funds for this purpose.

Bob Hull reported that paving has been completed on 725 North, Terrace Drive intersection, Lake Drive from 564 to the first intersection North, and Quiet Harbor. He hopes to have quotes for two additional areas at the next Council meeting: 1) north of the Yacht Club and 2) south of the Marina. He also discussed possible changes in road permit process, and requested input from the Council and general public.

Bob also reported on the sewer system. He requested approval to purchase a spare pump for the lift station. He has a quote of $6,200 from E-One. Tony Kraus made a motion to purchase the pump, seconded by Larry Armstrong, and the motion passed.

Larry Armstrong made a motion to accept the reports from the Marshal, the Zoning Inspector and the Town Superintendent. Tony Kraus seconded, and the motion to accept all reports passed.

Report on litigation by Don Stuckey. He reported that one piece of the Hoagland litigation is gone and we are down to three suits. In the Geiger case, the depositions are upcoming.

NEW BUSINESS

Jack McArdle introduced Resolution 2005 – 7, a resolution to accommodate those individuals who will be damaged by the moratorium on sewer connections that will remain in effect until the performance of the system can be tested with the high volume flow during Labor Day weekend.

Tony Kraus moved approval of the Resolution, Larry Armstrong seconded, and the motion passed.

Greg Brown reported on the Lakes Council annual meeting which was held on Saturday,
August 13. The Council approved a recommendation to proceed with setting up a new land trust.

At 8:20 p.m. Tony Kraus made a motion to adjourn, Larry Armstrong seconded, and the motion passed.

RESOLUTION 2005 – 7


The moratorium on the sewer connections will remain in effect until the performance of the system is tested by the high volume flows on Labor Day weekend. It will be
re-evaluated when we have that information.

In order to accommodate those individuals who will be damaged by this action, and because competent authority has informed us that a 1% increase will not materially affect the performance of the system, we are prepared to grant a limited number of
sewer permits for those individuals who can demonstrate to the sewer board a
compelling hardship. The nature of the hardship must be fully described in a special hardship sewer permit application.

Permits will be granted on the basis of the nature of the hardship and the suitability of
the site for the intended purpose.

Application must be for specific building sites to be used for single family residences. The sites must be identified by legal description and survey.

The sewer permit application must be accompanied by a completed ILP application.

Action must commence on the proposed construction within 60 days or the permit is revoked.

Permits are only for the specific sites as designated and are not transferable.

The applications must be accompanied by a check for a $5,300.00 impact fee.
