Minutes of the December 12, 2005 Town Council Meeting

The December 12, 2005 Town Council meeting was called to order at 7:08 p.m. by Jack McArdle, President. Also present were Larry Armstrong and Tony Kraus, Councilmen, Donald Stuckey, Town Attorney, Virginia Nye, Clerk Treasurer, Bruce Snyder, Zoning Inspector, and Bob Hull, Town Superintendent. Twenty-one people signed the guest register.

The minutes of the November 14, 2005 Town Council minutes were read by Virginia Nye. Larry Armstrong made a motion to approve the minutes with corrections and Tony Kraus seconded. The motion was approved.

Virginia Nye gave the financial report for the month of November. Fund balances for November are as follows:

        General Fund                 $540,967.20
        Garbage Account           $304,915.64
        Sewage Works Utility    $948,492.86
        Build Indiana Fund         $ 63,868.45

Warrants needing approval of the Council totaling $59,464.43 were read. Tony Kraus moved approval, Larry Armstrong seconded and the motion passed.

Resolution 2005-8 (Resolution to Transfer Funds) was read. Tony Kraus made the motion to approve, Larry Armstrong seconded and the motion passed.

Tony Kraus gave the Marshal’s report as well as the Fire Department report for the period, November 14 to December 12.

Bruce Snyder gave the Zoning and Building Report. One Improvement Location Permit was issued during the period November 15 to December 12, 2005. It was for James Nevin, 1120 Lake Drive for a new garage. A demolition permit was issued for garage tear down at same address. There will be a regularly scheduled BZA meeting on December 19, 2005. The BZA will hear 5 applications for variances from the Clear Lake Code of Zoning Ordinances. On December 20, 2005 the BZA will conduct the continued hearing on the Hoagland appeal of the issuance of the Improvement Location Permits to Dr. and Mrs. James Nevin.

Bob Hull, in his report to the Council, requested Council approval for the use of SDR35 pipe as the proper pipe in the connection of the condos to the sewer. He also discussed possible engineering for road work in the town for next year. He met with Andy Dodzik from DLZ Engineering in November. In their tour of streets, the area north of the Yacht Club received special attention due to the continuing problem of standing water on the roadway. Bob Hull requested approval from the Council to hire DLZ Engineering for this as well as to develop an engineering program for other town streets. Larry moved approval of hiring DLZ Engineering, Tony Kraus seconded, and the motion passed..

Tony Kraus recommended approval of all reports, Larry Armstrong seconded and the motion passed.

OLD BUSINESS

Don Stuckey discussed the litigation on the Geiger and Hoagland cases. Mediation on the Geiger suit is scheduled for February. Hunt Suedhoff Kalamaros LLP attorneys hope to file for summary judgment in Hoagland case in the near future.

Larry Armstrong reported that the survey on the property for the town hall is still not complete. This is preventing startup for the foundation of the building. The Council requested a deadline of Friday for the survey, after which they should talk with other surveyors.

In order to complete the three readings of the following ordinances, Tony Kraus made a motion to pass the second reading by number only. The motion was seconded by Larry Armstrong and the motion passed.

Ordinance 309, second reading. Tony Kraus made a motion to pass Ordinance 309 by number only, Larry Armstrong seconded, and the motion passed.

Ordinance 310, second reading. Larry Armstrong made a motion to pass Ordinance 310 by number only, Tony Kraus seconded, and the motion passed.

Ordinance 311, second reading. Tony Kraus made a motion to pass Ordinance 311 by number only, Larry Armstrong seconded, and the motion passed.

Larry Armstrong made a motion to pass the third reading of Ordinances 308, 309, 310 and 311 by number only, Tony Kraus seconded, and the motion passed.

Ordinance 308, third reading. Tony Krause made a motion to pass Ordinance 308 by number only, Larry Armstrong seconded, and the motion passed.

Ordinance 309, third reading. Larry Armstrong made a motion to pass Ordinance 309 by number only, Tony Kraus seconded, and the motion passed.

Ordinance 310, third reading. Tony Kraus made a motion to pass Ordinance 310 by number only, Larry Armstrong seconded, and the motion passed.

Ordinance 311, third reading. Larry Armstrong made a motion to pass Ordinance 311 by number only, Tony Kraus seconded, and the motion passed.


NEW BUSINESS

Resolution 2005-9, a resolution that the Clear Lake Town Attorney shall take legal action to assure the hook up of persons who have neither received a permit to hook up nor have hooked up to the Clear Lake sewage system, was introduced for approval. Tony Kraus moved approval, Larry Armstrong seconded and the motion passed.

At 8:05 p.m. Tony Kraus made a motion to adjourn, Larry Armstrong seconded, and the motion passed.
