MEETING MINUTES

Minutes of the February 13, 2006 Town Council Meeting

The February 13, 2006 Town Council meeting was called to order at 7:05 p.m. by Tony Kraus, Councilman. Also present were Jack McArdle, President, Virginia Nye, Clerk Treasurer, Bruce Snyder, Zoning Inspector, and Bob Hull, Town Superintendent. Twenty four people signed the guest register.

Tony Kraus introduced the new town attorney, W. Erik Weber, of the law firm Mefford and Weber, from Auburn, Indiana. The other members of the law firm, Donald T. Mefford and Neal R. Blythe, were present and were introduced.

The minutes of the January 9, 2006 Council meeting were read by Virginia Nye. Tony Kraus moved approval, Jack McArdle seconded, and the motion passed.

The financial report for January and the warrants to be approved by the Town Council were read by Virginia Nye. Tony Kraus moved approval, Jack McArdle seconded, and the motion passed.

Jack McArdle read the Marshal’s report and Tony Kraus reported for the Fremont Fire Department. Clear Lake had a total of 20 calls during the year 2004, and also for 2005 while Clear Lake Township had a total of 20 calls during 2004 and 26 calls during 2005.

Bruce Snyder, Zoning Inspector, reported that there were two Improvement Location Permits issued in the period January 10 to February 13, 2006. Two demolition permits were issued during this same time period. The Board of Zoning Appeals will hold its regularly scheduled meeting on February 21 and will hear three applications for variances from the Clear Lake Code of Zoning Ordinances.

Bob Hull reported that we continue to work on the evaluation of the sewer line to Fremont. He has met with Mark Sullivan, Commonwealth Engineering, and Bob Jordan, Fluid & Thermal Systems (formerly Keller Rivest, Inc.). They are collecting data to determine if the problem is the air relief valves or a winter low flow problem.

The Dennis Koehlinger property at 1030 Lake Drive, which was to be demolished starting February 6 by the town, will be razed by Bill Scheumann. M&C Trenching has already removed the grinder. The grinder can be reinstalled when an easement is located at the time construction requires it. Mr. Koehlinger must continue to pay the monthly sewer bill in order to guarantee the reinstallation.

Bob Hull also reported that DLZ Engineering has started the engineering for the road project north of the yacht club. It should be ready for bid by the middle of April.

For a fee of $10,000 Region III-A has submitted a proposal to review, update and make any recommended changes to the comprehensive plan.

OLD BUSINESS

Tony Kraus reported that in early February Mr. Hoagland served a tort claim notice to the town relative to a missing deck and staircase on an easement of neighboring property. In the Hoagland application for judicial review of the BZA, Don Stuckey filed a motion to dismiss because the wrong statute was cited.

Geiger depositions have been taken. The mediation has been moved into March. Don Stuckey will continue to represent the town on this lawsuit.

Town hall update: An offer on the site has been made and accepted. The town plans to break ground in the spring.

NEW BUSINESS

Tony Kraus made a motion to hire Region III-A to review, update and make recommended changes to the comprehensive plan. Jack McArdle seconded, and the motion passed.

Jack McArdle announced the appointment of four members to the Plan Commission. They are Paul Federspiel and William A. Geiger, whose terms expire January 4, 2009, and Robert Bruick and Jerry McArdle whose terms expire January 4, 2010.

A resolution was introduced (Resolution 2006-1) to appoint three people from the town government to serve on the Plan Commission: John E. (Jack) McArdle, Larry Armstrong, and Anthony Kraus. A motion was made to accept Resolution 2006-1 by Tony Kraus and seconded by Jack McArdle, and the motion passed. These terms end December 31, 2007.

At 7:45 p.m. Tony Kraus made a motion to adjourn, Jack McArdle seconded, and the motion passed.
