Minutes of the May 8, 2006 Town Council Meeting
The May 8, 2006 Town Council meeting was called to order at 7:08 p.m. by Jack
McArdle, President. Also present were Larry Armstrong and Tony Kraus,
Councilmen, Virginia Nye, Clerk Treasurer, Bruce Snyder, Zoning Inspector,
Robert Hull, Town Superintendent, and Erik Weber and Neal Blythe, Town
Attorneys.
The minutes of the April 10, 2006 meeting were read by Virginia Nye. Larry moved
approval, with a second by Tony, and the motion passed.
Virginia Nye gave the financial report for April. Tony moved approval, Larry
seconded, and the motion passed. The warrants to be approved were read and Tony
moved approval, with a second by Larry and the motion passed.
Larry gave the Marshal’s report and the Fire Department report. The Fremont Fire
department report 241.72 man hours work, with no responses to the Town of Clear
Lake.
Bruce Snyder, Zoning Inspector, reported four Improvement Location Permits were
issued from April 11 to May 8, 2006. The Board of Zoning Appeals at its
regularly scheduled meeting on April 17 heard one application for a variance. A
demolition permit was issued for a tear down at 960 Lake Drive.
Bob Hull attended a grinder pump and maintenance school sponsored by E-One pumps
and found it to be very informative. While changing the number one lift station
pump, he noticed some spots that needed attention on the new coating. Baughman
Inc. recoated the areas at no charge to the town. All the sewer lines at the
condos have now been replaced and the hook-up is now complete.
DLZ has started the engineering on the curve at 176 Lake Drive. By combining
this work with the road work near the Yacht Club we hope to get a better price
on the road repair.
Tony Kraus moved approval of the reports, Larry Armstrong seconded, and the
motion carried.
OLD BUSINESS
Erik Weber, Town Attorney, reported on the town legal cases filed by the
Hoaglands against the Town of Clear Lake. He also reported that a tentative
settlement has been reached in the Geiger vs. Town of Clear Lake case. Erik
Weber prepared two ordinances which are scheduled for first reading at this
meeting.
Larry Armstrong reported that property, adjacent to the pump station, has been
purchased for construction of the Town Hall, and the construction committee has
scheduled the next work to be done.
NEW BUSINESS
Ordinance 2006-2 – An Ordinance Repealing Section 91.02 of the Clear Lake Code
of Ordinances. This ordinance was recommended by the Plan Commission because
satellite communications are regulated by the Federal Communication Commission,
under the Federal Communication Act. First reading: The ordinance was introduced
by Jack McArdle. Tony Kraus moved approval of the first reading, Larry Armstrong
seconded, and the motion passed.
Ordinance 2006-3 – An Ordinance Amending and Modifying Section 92.01 Protection
of Public Streets, Alleys, Highways and Sewers. First reading: The ordinance was
introduced by Jack McArdle. Tony Kraus moved approval of the first reading,
Larry Armstrong seconded, and the motion passed.
Resolution 2-2006. A Resolution to Authorize Settlement of Geiger Excavating,
Inc. vs. Town of Clear Lake, et al. Cause No. 76C01-0405-PL-0247. Jack McArdle
read the summary. The resolution provides authority to John McArdle, Larry
Armstrong, and Anthony Kraus to ratify and execute a settlement in the lawsuit
entitled Geiger Excavating, Inc. vs. Town of Clear Lake, IN and Commonwealth
Engineers, Inc. pending in Steuben Circuit Court. Tony Kraus moved approval,
Larry Armstrong seconded, and the motion passed.
COMMENTS FROM ATTENDEES
Minutes of the May 3, 2006 Sewer Board meeting will be read at the June Council
meeting and then will be available. Findings of the Sewer Board will be placed
on the website.
Bob Troll reminded everyone that it is time to install swim buoys. The
Department of Natural Resources rule is that buoys should be placed 200 feet
from shore. There is a 200-foot rope available at the Town Hall for measuring
proper distance from the shore.
Relative to the construction on the island, Tony Kraus recommended acceptance of
letter of credit be in place before work can begin. Larry Armstrong seconded and
the motion passed.
At 8:14 p.m., Larry Armstrong made a motion to adjourn, seconded by Tony Kraus
and the motion passed.
