Minutes of the June 12, 2006 Town Council Meeting
The June 12, 2006 Town Council Meeting was called to order at 7:05 p.m. by Jack
McArdle, President. Also present were Tony Kraus and Larry Armstrong,
Councilmen, Virginia Nye, Clerk Treasurer; Bruce Snyder, Zoning Inspector,
Robert Hull, Town Superintendent, and Erik Weber and Neal Blythe, Town
Attorneys. Thirty eight people signed the guest register.
The minutes of the May 8, 2006 meeting were read by Virginia Nye. Tony Kraus
moved approval, Larry Armstrong seconded, and the motion passed.
Warrants to be approved were read by Virginia Nye. Larry Armstrong moved
approval, Tony Kraus seconded, and the motion passed.
Larry Armstrong gave the Marshal’s report and the Fremont Fire Department
report. The Fire Department made two calls to the Town of Clear Lake.
Bruce Snyder, Zoning Inspector, reported there were six Improvement Location
Permits issued from May 9 to June 12, 2006. He also announced that the Board of
Zoning Appeals will hold its regular meeting on June 19, to hear one application
for a variance.
Bob Hull reported that they have noticed the pumps are working better and there
is indication that heavier flows are scouring the main line into Fremont. He
also reminded everyone to keep in mind the possible need to access the grinder
pumps for service. Bob also reported on the street work that is being done.
Tony Kraus made a motion to approve the reports, Larry Armstrong seconded, and
the motion passed.
Eric Weber reported on: Appeal from the November 14, 2005 ILP for James and
Cathlene Nevin, 1120 Lake Drive, Clear Lake. Motion to dismiss Plaintiff’s Writ
of Certiorari is set for July 24, 2:00 p.m. in the Steuben Circuit Court.
Daniel E. Hoagland, Karen Hoagland, and the Hoagland Limited Family Partnership
LLP vs. Clear Lake Board of Zoning Appeals. The Steuben Circuit Court in April
dismissed this Writ. The Plaintiff has appealed the decision by filing a Motion
to Correct Errors. A response was filed, a hearing is set for July 24, 2006 at
2:00 p.m. in the Steuben Circuit Court.
Bill Geiger gave a presentation on the status of the new town hall. Bill Geiger,
Bob Hull, Larry Armstrong, and Jerry McArdle have been the committee planning
and designing the town hall. It will be located on 725 East, near the lift
station. The plan is for 2,200 square feet, with a full basement, with some
windows in the basement. This would be space to grow into. Parking for 40
designated spaces has been planned, along with a gravel back lot.
Larry Armstrong discussed the swim buoy locations and allocations.
NEW BUSINESS
Tony Kraus reopened the public hearing on Ordinance 2006-1, An Ordinance
Vacating a Portion of Prospect Street. There were no comments. Larry Armstrong
made the motion to close the public hearing, Tony Kraus seconded, and the motion
passed. On the motion by Larry Armstrong to approve Ordinance No. 2006-1, both
Armstrong and Kraus voted no.
Second reading of Ordinance No. 2006-2. An Ordinance Repealing Section 91.02 of
the Clear Lake Code Ordinance, entitled “Satellite Dishes.” Tony Kraus moved
approval of the ordinance by number, Larry Armstrong seconded and the motion
carried.
Second reading of Ordinance No. 2006-3. An Ordinance Amending and Modifying
Section 92.01 Protection of Public Streets, Alleys, Highways and Sewers. Tony
Kraus moved approval of the ordinance, second reading by title only, Larry
Armstrong seconded and the motion passed.
Resolution 2006-3. In the case of Geiger vs. the Town of Clear Lake, settlement
has been reached between all parties. The settlement of the Geiger lawsuit has
been signed.
Resolution 2006-4. Tony Kraus moved approval of awarding the contract for the
Engineer of the Town Hall, Larry Armstrong seconded and the motion carried.
Resolution 2006-5. Tony Kraus moved approval of accepting the Watson Well
Drilling bid of $2,000. Larry Armstrong seconded, and the motion carried.
Resolution 2006-6. Tony Kraus moved Approval of the Fremont Fire Department
Contract for the years 2006 and 2007. Larry Armstrong seconded, and the motion
passed.
The Notice to Taxpayers of Hearing on Proposed Cumulative Capital Development
Fund under Indiana Code 36-9-15.5 was read by Jack McArdle. Larry Armstrong
moved approval, Tony Kraus seconded and the motion passed.
At 8:00 p.m. Tony Kraus made the motion to adjourn, seconded by Larry Armstrong
and the motion passed.
