MINUTES OF THE JULY 10, 2006 TOWN COUNCIL MEETING

The July 10, 2006 Town Council Meeting was called to order at 7:05 p.m. by Jack McArdle, President. Also present were Larry Armstrong, Councilman, Virginia Nye, Clerk Treasurer; Bruce Snyder, Zoning Inspector, Robert Hull, Town Superintendent, and Erik Weber and Neal Blythe, Town Attorneys.

Minutes of the June 12 meeting were read and approved, with one correction of the Ordinance 2006-1 number, upon the motion of Larry Armstrong, second by Jack McArdle.

The financial report for May 2006 and the Warrants to Be Approved to July 10, 2006 were reported. Larry Armstrong moved approval, Jack McArdle seconded, and the motion passed.

Larry Armstrong gave the Marshal’s report. There was no report from the Fremont Fire Department.

Bruce Snyder reported that four Improvement Location Permits, one for a new home and three for garages, were issued from June 13 to July 10, 2006. He also issued two demolition permits.

Bob Hull reported that the sewer system worked flawlessly over the July 4th weekend. They believe that the chemical bioxide, used for odor control, has been responsible for the buildup clogging the air relief valves. They plan to use a new product for this purpose. Bob also reported that new street signs have been installed and he has used five tons of coldpatch to fill potholes. Plans for this year’s street work is complete and ready for bids. They would like to bid the project and start the work shortly after Labor Day.

Larry Armstrong moved approval of the reports, Jack McArdle seconded, and the motion passed.

OLD BUSINESS

     Erik Weber reported on a variety of legal matters facing the town. Two appeals by the Hoaglands will be heard in Steuben Circuit Court on July 24, 2006 at 2:00 p.m. In the Daniel Hoagland, et al vs. Town of Clear Lake in the Steuben Superior Court, several motions regarding discovery disputes are pending at this time. Other issues involve annexation of two parcels on Round Lake, the Town Hall real estate development, sewer connection issues, ordinances codification, as well as Hoagland vs. James and Kathy Nevin and Town of Clear Lake in Steuben Circuit Court.

     The Board suspended the rules and placed on the agenda Resolution 2006-8, a Resolution to Approve the Budget for the Town Hall, for an amount up to $150,000.

NEW BUSINESS

     Third Reading. Ordinance 2006-2. An Ordinance Repealing Section 91.02 of the Clear Lake Code of Ordinances. Jack McArdle read the summary of the ordinance. Larry Armstrong made the motion to approve the third reading, Jack McArdle seconded, and the motion passed.

     Third Reading. Ordinance 2006-3, the Road Cut Ordinance. The summary was read, followed by Larry Armstrong’s motion to approve, second by Jack McArdle, and the motion passed.

     Ordinance 2006-4. Re-establishing the Cumulative Capital Development Fund. This is at the DLGF maximum rate of .05. This will increase the annual income from CCD from $20,000 to $25,000 per year. Larry made a motion to approve the ordinance as read, Jack seconded and the motion passed.

     Resolution 2006-7. Resolution to suspend the rules, amend agenda to add the resolution, Resolution to Approve Excavation Work on County Road 725 East, Town of Clear Lake. Larry Armstrong made the motion to suspend the rules, Jack McArdle seconded, and the motion passed. Larry Armstrong made the motion to approve the resolution, Jack McArdle seconded and the motion was approved.

     Resolution 2006-8. A Resolution to Approve the Budget for the Town Hall. That budget of $150,000 is authorized for the Development of the Town Hall facility, and said project shall be appropriated from the town sewer fund or other appropriate fund approved by the Town Council. Larry Armstrong made the motion to approve, Jack McArdle seconded, and the motion passed.

At 8:00 p.m., Larry Armstrong made the motion to adjourn, Jack McArdle seconded and the motion passed.
