MINUTES OF THE OCTOBER 8, 2007 TOWN COUNCIL MEETING
The meeting was called to order at 7:00 p.m. by Jack McArdle, Council President. Also present at the meeting were Larry Armstrong, Tony Kraus, Council, Virginia Nye, Clerk Treasurer, Bob Hull, Town Superintendent, Bruce Snyder, Zoning Inspector, and Neal Blythe, Town Attorney. Thirty people signed the guest register.
The minutes of the September 10 meeting were read by Virginia Nye. Tony Kraus made the motion to approve the minutes, Larry Armstrong seconded, and the motion passed.
The financial report included the Voucher Register, Warrants to be Approved, and the expenses and revenue for the months of July and August. The financial reports were approved on the motion of Larry Armstrong, and second by Tony Kraus.
The Marshal’s report was given by Larry Armstrong, followed by the Fremont Fire Department report given by Tony Kraus. The Fire Department responded to one medical assist at Clear Lake.
Bruce Snyder, Zoning Inspector, reported that there were eight Improvement Location Permits issued, including new homes, remodeling homes, new deck and a three-season room, new porch. Four demolition permits were issued. He also announced a meeting of the Board of Zoning Appeals on October 15 at 7:00 p.m.
Bob Hull’s report included sewer cleaning by Dilts Excavating from the lift station and receiving pit. Work continues on the areas of 748 and 178 Lake Drive. We aim to have the street work completed by October 15th. The garage from the Old Town Hall site will be moved to the New Town Hall site as soon as the concrete has cured enough. The drawings are finished for the new Street Barn. At $19,638, Brooks bid for the town hall parking lot was the lowest, and work should start on Wednesday, October 10 with completion by October 12.
Laura Farquhar reported that we continue to receive some Garbage payments and she is still working on the billing for the sewer that we will bring in house the first of January.
Larry Armstrong made the motion to approve reports, seconded by Tony Kraus, and the motion carried.
OLD BUSINESS
Neal Blythe reported on the town’s litigation. No settlement has been reached, some discovery remains to be done. In the case of the three complaints filed by Hoagland to the public access counselor, the complaints are being consolidated into one case, and the attorneys will be working on these.
NEW BUSINESS
ORDINANCE NO. 2007-3. AN ORDINANCE AMENDING CLEAR LAKE ORDINANCE 277. An ordinance amending Ordinance 277 and corrects a scrivener’s error in the legal description contained in the original ordinance. Tony Kraus made a motion to read by summary only, second by Larry Armstrong and the motion passed. For first reading, Larry Armstrong made a motion to approve the ordinance, Tony Kraus seconded and the motion passed.
Second reading of Ordinance 2007-3. Tony Kraus read the summary of the ordinance. Larry Armstrong then made the motion to approve the second reading, Tony Kraus seconded and the motion passed.
Third reading of Ordinance 2007-3. Tony Kraus read the summary of the ordinance. Larry Armstrong then made the motion to approve the third reading. Tony Kraus seconded and the motion passed.
ORDINANCE NO. 2007-4. ORDINANCE ENACTING AND ADOPTING A SUPPLEMENT TO THE CODE OF ORDINANCES OF THE TOWN OF CLEAR LAKE. This ordinance adopts the 2007 Supplement to the Code of Ordinances of the Town of Clear Lake as submitted by the American Legal Publishing Company of Cincinnati, Ohio. Tony Kraus made the motion to read by summary only, second by Larry Armstrong the motion passed. Tony Kraus then made the motion to approve the first reading, Larry Armstrong seconded and the motion passed.
RESOLUTION 9-2007. A RESOLUTION QUITCLAIMING CERTAIN REAL ESTATE ADJACENT TO LOT 8 BLOCK 8 OF THE ARCADIA BEACH ADDITION TO THE TOWN OF CLEAR LAKE, INDIANA. This resolution quitclaims certain real estate adjacent to Lot 8 Block 8 of the Arcadia Beach Addition to the Town of Clear Lake, Indiana. Larry Armstrong made to the motion to approve, Tony Kraus seconded and the motion passed.
Bob Troll reminded everyone to vote on election day, November 6, The Clear Lake Town Hall will be the voting site for the town this year.
At 7:45 p.m. Tony Kraus made the motion to adjourn, Larry Armstrong seconded, and the motion passed.
