MINUTES OF THE JULY 9, 2007 MEETING OF THE TOWN COUNCIL

 

 

OPEN REGULAR MEETING OF TOWN COUNCIL, July 9, 2007 meeting,  7:00 PM

Present: Jack McArdle, Town Council President; Larry Armstrong, Councilman; Anthony Kraus, Councilman; Virginia Nye, Clerk Treasurer; Bob Hull, Town Superintendent; Bruce Snyder; Zoning Director;  Eric Weber, Neal Blythe, Town Attorneys; Laura Farquhar, Billing Clerk

           

Minutes of June 11, 2007 Regular Council Meeting; read by Virginia Nye, Clerk; Larry Armstrong moved approval, Tony Kraus seconded, motion passed;

 

Financial Reports were read by Virginia Nye, the Expense Voucher Register and the Revenue and Expenses for May 2007, were reported.  Tony made the motion to approve them, Larry Armstrong seconded and the motion passed.

 

Larry Armstrong gave the Marshal’s report and the Fremont Fire Department report for those events responded to in Clear Lake. Bruce Snyder, Zoning Inspector, reported on 6 Improvement Location Permits for a new fence, 2 decks, a fence, a new house and a swimming pool and fence.   At the BZA meeting, a fence variance was granted to Paul and Rebecca Allison to allow them to build a 5-foot fence around their proposed swimming pool.

 

Bob Hull, Town Superintendent, reported that the sewer system worked well through the 4th of July holiday.  The drainage problem between 386 and 388 should be corrected with a drain between the two properties.  Following a survey and a legal description of the area he hopes to have Eric Weber do the legal work necessary so that work can be performed before winter.

 

OLD BUSINESS

 

Eric Weber reported on the Hoagland activity.  He also said that sewer delinquency is being worked on by sending  notices of Liens to be filed on the delinquent properties. 

           

The auction of the Old Town Hall and the land will take place at noon on Saturday, July 14, 2007.  The property is for residential use only and will be sold by parcel or as a whole.  By State Statute there will be a Reserve as regulated by the Statute.

 

NEW BUSINESS

 

Larry Armstrong reported on the committee work on the Unified Development Ordinance.  There is to be an open meeting on Saturday,  July 14, 2007, which will include a report and open discussion of the Ordinance.  Ground Rules, the company doing the basic work, will be there to explain their role

 

.           Larry also reported on the 2008 Fire Contract with the Fremont Fire Department.  There will be a 10 percent increase in the rate for the year 2008, increasing the rate to $21,614. 

 

There is to be a Public Hearing on the Town of Fremont sewer tap fee increase, which will include everything along State Road 120, but not the Town of Clear Lake

 

It was announced that Mike Long has been selected to fill a position on the Board of Zoning Appeals.

 

The Clear Lake Ordinance (2007-2) banning the use of fertilizer, containing phosphorus, has been contested by Mr. Hancock,  Fertilizer Administrator for the State of Indiana.  Eric Weber will follow up on this.

 

COMMENTS FROM ATTENDEES 

 

There was discussion about the use of fireworks at inappropriate times during the holiday period.  It was suggested that complaints should be filed for the Marshal to handle or the Sheriff, if after hours. People complained that dogs were running loose on the Island, making a mess.  Some one suggested that the Marshal should enforce the leash ordinance.  Since the events occurred on the Island, our ordinance may need to be reworked.  A question was asked about the number of people who have not connected to the sewer.   Eric Weber replied that Liens will be filed to compel hooking up.

 

At 8:00 PM, Tony Krause moved adjournment, Larry Armstrong seconded and the motion passed.
