MEETING MINUTES

Minutes of the August 11, 2008 Town Council Meeting

The Town Council meeting was called to order at 7:00 p.m. by Larry Armstrong, President of the Council. Present also were Paul Federspiel, Bob Lewis, Sue Williams, George Schenkel, Council members. Virginia Nye, Clerk, Bob Hull, Town Superintendent and Neal Blythe, Town Attorney were also present. Fifteen guests signed the guest register.

Minutes of the July 14, 2008 Council meeting were read by Virginia Nye and were approved upon a motion by George Schenkel and second by Bob Lewis.

Larry Armstrong reported that The Clear Lake Association donated a total of $7,000 to the town to be used for a neighborhood watch program, swim buoys, chain and anchors, and landscape for the town hall. The town accepted the generous donation upon a motion by Sue Williams, second by George Schenkel, with a unanimous vote by the Council.

The financial report included expenses as follows: General Fund, $87,035.63, Garbage Fund $4,640.40 and Sewer Fund $34,808.62. There were a total of twenty warrants to be approved for a total of $118,289.85. Paul Federspiel made a motion to approve the financials, Bob Lewis seconded, and the motion passed.

There was no Marshal’s report. The Fremont Fire Department reported a medic assist, a trash fire complaint and a boat fire at the Town of Clear Lake. The Fremont Fire Department, at a cost of $500, will install a hydrant at the access site. The Lions Club and the Clear Lake Association shared the cost of the installation. There is one more site at the north end of the lake that needs equipment.

Bruce Snyder reported there were four Improvement Location Permits issued for construction. One permit was issued to demolish the home at 596 Lake Drive. The Board of Zoning Appeals was scheduled to hear two variance applications at the August 17, 2008 meeting of the Board of Zoning Appeals.

Bob Hull’s report included the street paving that is finished and it turned out very well. And looking forward to winter weather, Bob requested permission to purchase a new spreader. Paul Federspiel made the motion to approve the purchase of the spreader, George Schenkel seconded, and the motion passed.

The work on the pole barn continues -- the floor is finished and the siding is almost completed, with the exception of a small portion of trim. The overhead doors should be installed soon.

The dead trees that were in front of the Town Hall have been removed, including the stumps. Landscaping has been planned for the area in front of the building.

Laura Farquhar continues to work with the Small Claims Court to get payment from unpaid billings.

Bob Lewis made the motion to accept the reports, George Schenkel seconded, and the motion passed.

OLD BUSINESS

Neal Blythe, Town Attorney, reported on the pending legal matters before the town.

NEW BUSINESS

ORDINANCE 2008-1. ANIMAL CONTROL ORDINANCE. The ordinance is on the website. The Animal Control Ordinance will be considered at the September 8 Council meeting.

ORDINANCE 2008-3. AN ORDINANCE AMENDING CLEAR LAKE ORDINANCE 256, CODIFIED IN THE CLEAR LAKE CODE AT ARTICLE VII, CHAPTER 72, 72.01, REGARDING PARKING MOTOR VEHICLES WITHIN THE TOWN OF CLEAR LAKE, INDIANA.

Following the reading of the ordinance, Paul Federspiel made the motion to pass, Bob Lewis seconded, and the motion passed. The ordinance will be published again.

Sue Williams made the motion to adjourn, Bob Lewis seconded, and the meeting was adjourned.
