MEETING MINUTES

Minutes of the September 22, 2008 Special Town Council Meeting

The Town Council meeting was called to order at 7:00 p.m. by Larry Armstrong, President of the Council. Council Members present were Larry, Bob Lewis and George Schenkel. Also present were Virginia Nye, Clerk, Bob Hull, Town Superintendent and Neal Blythe, Town Attorney. Eleven guests were also present.

Items addressed were as follows:

1. ORDINANCE 2008-8. AN ORDINANCE VACATING A PORTION OF ARCADIA DRIVE, TOWN OF CLEAR LAKE.

This ordinance authorizes the vacation of a portion of the approximate 20 foot wide right of way, known as Arcadia Drive, Town of Clear Lake, Indiana.

George Schenkel made the motion to close the meeting and to open a public hearing for discussion to vacate the property. Bob Lewis seconded and the motion passed.

Following discussion, George Schenkel made the motion to close the public hearing, Bob Lewis seconded the motion and the motion passed. Bob then made the motion to open the special meeting, George Schenkel seconded, and the motion passed. Bob then made the motion to approve the first reading of the motion, George seconded and the motion passed. The second and third readings will occur at the October and November meetings.


2. REVISIONS TO THE SEWER RATE ORDINANCE.

Neal Blythe will contact John Julian of Umbaugh to discuss the sewer rate ordinance before any change is made.


3. ORDINANCE 2008-9. CODIFICATION OF TOWN ORDINANCES.

This ordinance adopts the 2007 Supplement to the Code of Ordinances of the Town of Clear Lake as submitted by the American Legal Publishing Company of Cincinnati, Ohio. Bob Lewis read the Ordinance Enacting and Adopting a Supplement to the Code of Ordinances of the Town of Clear Lake. Bob Lewis then made the motion to recess the meeting, George Schenkel seconded, and the motion passed.

At the close of discussion of the codification, George Schenkel made the motion to close the recess, Bob Lewis seconded and the motion passed.

Bob Lewis then made a motion to adopt the ordinance, George Schenkel seconded, and the motion passed.

George Schenkel made the motion to adopt the second reading of the ordinance, Robert Lewis seconded and the motion passed.

For the third reading of the ordinance, Robert Lewis made a motion to approve, George Schenkel seconded and the motion passed. The third reading approves the adoption of the ordinance for the Codification of Town Ordinances.

4. ORDINANCE 2008-10. AN ORDINANCE MODIFYING THE ZONING CODE OF THE TOWN OF CLEAR LAKE

Bob Lewis read Ordinance 2008-10. This ordinance modifies the Zoning Code of the Town of Clear Lake, by removing the pyramid structure of the zoning districts.

Bob Lewis made the motion to open discussion, with a second by George Schenkel. With no discussion, George Schenkel made a motion to close discussion, Bob Lewis seconded and the motion passed.

First Reading: George Schenkel made a motion to adopt, Bob Lewis seconded, and the motion passed.

Second Reading: George Schenkel made a motion to adopt, Bob Lewis seconded, and the motion passed.

Third Reading: George Schenkel made a motion to adopt, Bob Lewis seconded, and the motion passed.

5. ORDINANCE 2008-7. CHANGES TO THE 2008 SALARY ORDINANCE. SECOND READING

Bob Lewis made the motion to close the council meeting and open the meeting for public input, George Schenkel seconded the motion passed. Following discussion, Bob Lewis made the motion to close the public hearing, George Schenkel seconded and the motion passed.

First Reading. George Schenkel made the motion to adopt the ordinance, Bob Lewis seconded, and the motion passed

Second Reading. George Schenkel made the motion to adopt, Bob Lewis seconded, and the motion passed.

Third Reading. George Schenkel made the motion to adopt, Bob Lewis seconded, and the motion passed.

6. CONSIDERATION OF A CONTRACT WITH STEUBEN COUNTY FOR GIS SERVICES.

The Council discussed a Data Sharing Agreement for Steuben County GIS and Interior Communities. This would be an interagency agreement. George Schenkel made the motion to accept the contract, Bob Lewis seconded and the motion passed.

7. ORDINANCE 2008-6. AN ORDINANCE ESTABLISHING FEES FOR RETURNED CHECKS.

Bob Lewis made the motion to close the council meeting and open the meeting for public input, George Schenkel seconded the motion passed. The fee discussed was $20 plus a charge from a bank charge of a possible $7.50. Following discussion, Bob Lewis made the motion to close the public hearing, George Schenkel seconded and the motion passed.

The first reading occurred at the September 8, 2008 Council Meeting and was approved at that time..

Second Reading. Bob Lewis made the motion to adopt, George Schenkel seconded, and the motion passed.

Third Reading. George Schenkel made the motion to adopt, Bob Lewis seconded, and the motion passed.

8. TRACTOR BID

There is $11,000 left over in sewer funds, and the town must use these or start to lose the funds. Bob Lewis made the motion to approve purchase of the John Deer tractor, George Schenkel seconded and the motion passed.

9. PLAN COMMISSION APPOINTMENT

Larry Armstrong nominated George Schenkel as appointment to the Plan Commission, Bob Lewis seconded, the motion passed.

10. DISCUSSION OF 2009 BUDGET AND REVENUE WITH RANDY TILBURY.

Randy Tilbury discussed with the Council members the various sources of revenue that the town can access and the need to keep expenses down.

At 8:20 p.m., Rob Lewis made the motion to adjourn, George Schenkel seconded, and the motion passed.
