MEETING MINUTES

Minutes of the November 10, 2008 Town Council Meeting

The Town Council meeting was called to order at 7:00 p.m. by Larry Armstrong, President. Present also were Council members Bob Lewis, George Schenkel, Sue Williams, and new Council member Barry Worl. Also present were Virginia Nye, Clerk/ Treasurer, Neal Blythe, Town Attorney, Bob Hull, Superintendent, and Bruce Snyder, Zoning Inspector. Twelve people signed the guest register.

Minutes of the October 13 Council meeting were read. There was one correction to the minutes. Bob Lewis made a motion to approve as corrected and Sue Williams seconded. With one abstention by Barry Worl, the Council approved the minutes of the October meeting.

Total expenses by fund are: General Fund $28,237.11, Garbage Fund $6,464.12 and Sewer Fund $29,486.04, for a total of $64,187.27. Warrants to be Approved totaled $48,243.38. The financial reports, including the Voucher Register, Revenue and Expenses for September, and Warrants to be Approved, were approved upon a motion by George Schenkel and second by Bob Lewis. Vote was approved by Council with the exception of an abstention by Barry Worl.

REPORTS

The Fremont Fire Department reported forty seven calls, one of which was a medic assist to the Town of Clear Lake.

Bruce Snyder reported that during the period October 14 until November 10, there were seven Improvement Location Permits issued. Two demolition permits were issued during this period.

The Bob Hull, Town Superintendent, report included the following: On November 1st, Marshal Gonya reported to Bob that a sewer alarm was going off. With the assistance of M&C Trenching, Geiger Electric, and the Marshal they were able to discover a broken small plastic bubbler line. While they were trouble-shooting the problem, Dilts Sewer Service was called to haul gray water to Fremont. The facility was monitored all weekend in order to keep things under control. A contractor from Fort Wayne made permanent repairs to the equipment on Tuesday.

Bob Hull, along with Sevits Tree Service, has found that brush and trees need trimming and/or removal. Sevits has given a quote of $1,800 for trimming work that needs to be done. Sue Williams made a motion to approve the work being done, George Schenkel seconded and the motion passed. Barry Worl abstained from the vote.

The street/sewer barn is nearing completion and Bob reported that the furnace saved from the old Town Hall will not work in the north end of the building as planned. Only one contractor has responded with a quote of $2,900 for installing a new ceiling furnace. Bob requested the Council’s approval for purchase of the furnace. In addition, Bob and Larry from M&C Trenching, will install the old furnace in the south end of the barn to keep it from freezing. Bob Lewis made the motion to approve, George Schenkel seconded and the motion passed, with one abstention.

Bob requested fans in the barn in the north end of the building, with wiring to the whole building. George Schenkel made the motion to approve request, Bob Lewis seconded, and the motion passed with one abstention.

OLD BUSINESS

Neal Blyth, our town attorney, updated the Council members on the litigation that the town is involved in.

NEW BUSINESS

ORDINANCE 2008-8. THE VACATION OF A PUBLIC STREET. Third Reading.

Larry Armstrong read the summary of the ordinance that vacates a portion of the approximately 20 foot wide right of way, known as Arcadia Drive.

Bob Lewis made the motion to approve the third reading of the ordinance, George Schenkel seconded the motion, and the motion passed, with one abstention.

ORDINANCE 2008-11. ORDINANCE SETTING SALARIES AND WAGES OF THE OFFICERS AND EMPLOYEES FOR THE TOWN OF CLEAR LAKE, INDIANA FOR THE YEAR 2009. Second and Third Readings.

Second Reading. Larry read the motion by title only and then asked for the motion to approve the second reading of the ordinance. Following discussion, George Schenkel made the motion to approve the second reading, Sue Williams seconded, and the motion passed, with one abstention.

Third Reading. Larry read the motion by ordinance title only, then asked for the motion to approve the third reading of the ordinance. Following discussion, George Schenkel made the motion to approve, Sue Williams seconded, and the motion passed, with one abstention.

George Schenkel raised questions about transferring the following property: Hanna Nature Preserve, Flora-Husselman Trumbull Nature Area and Clear Lake Park (the property South of 512 Lake Drive on both sides of the channel to Lake Ann) to the Clear Lake Township Land Conservancy. He also raised the question of staggering the terms of the Council, three Council members off at one time, two off at another time. Neal Blythe will research the questions and report back to the Council.

Larry Armstrong opened the meeting to comments from the audience. Following discussion, George Schenkel made the motion to adjourn at 7:45 p.m., Bob Lewis seconded and the motion passed.
