MINUTES OF THE APRIL 30, 2009 TOWN COUNCIL
The meeting of the Town Council was called to order at 7:00 p.m. by Bob
Lewis. Present also were Larry Armstrong, George Schenkel, Sue Williams, and
Barry Worl, Council members, Bob Hull and Virginia Nye. Eighteen people signed
the guest register.
Minutes of the March 9 and March 16 meetings were read and approved by the
council, upon a motion by Sue Williams and second by Larry Armstrong.
Expenses for the town during the month of April were: General Fund, $20,453.81, Garbage Fund $4,423.24, and Sewer Fund $41,936.46, for a total of $77,813.51. Warrants to be approved for the three funds totaled $99,684.19 for the period March 19 – April 28. The financial report was approved upon a motion by Larry Armstrong and second by George Schenkel.
Larry Armstrong gave the Marshal and Fire Department reports. The Marshal’s report included information that the Police Department made application for a grant for, and has received a camera and scanner, with a printer and camcorder on back order. The Fire Department report included a total of 41 total calls – none in Clear Lake.
Bob Lewis read the Building and Zoning Report for Bruce Snyder. The report included a permit to remodel an existing garage and a permit to remodel existing home.
Bob Hull received two quotes to install two 6-inch and one eight inch drainage tiles between 388 LD and 390 LD and one quote to install six inch drainage tiles. The Council voted to accept the Crawford Excavating Inc. bid of $2,982.25 upon the motion of Larry Armstrong and second by Barry Worl.
There are two or three areas of streets that will require work this spring. Bob will bring to the next council meeting a proposal to work on these areas.
Bob has in hand two quotes for a new 6-foot bush hog. They are for: Great
Lakes Green Power, $2,500, and Purdy Tractor and Equipment, $1,674.40. He
recommended that we purchase the one from Purdy for $1,674.40. Sue Williams made
the motion to approve the purchase of the Purdy Tractor, George Schenkel
seconded, and the motion passed.
UNFINISHED BUSINESS
Neal Blythe reported on pending legal cases with the Hoaglands. He also reported that the case of Dick Lehman has been settled. The McCue vs. Kraus case has reached settlement. Copies of the settlement documents are in the Town Hall.
ORDINANCE 2009-1. ORDINANCE REGULATING THE REMOVAL OF WEEDS AND OTHER RANK VEGETATION. SECOND READING. Bob Lewis read the summary of the ordinance. The Ordinance authorizes the Town of Clear Lake to remove weeds and rank vegetation and assess costs of such removal to the owner of the subject real estate. Larry Armstrong made a motion to read by title only, George Schenkel seconded, and the motion passed.
George Schenkel made the motion to open the public hearing, Barry Worl seconded, and the motion passed.
The ordinance declares that if the owner fails to remove the weeds and/or rank vegetation within the time granted to the owner by the Town Council, the Town may remove, or cause to be removed, such weeds and/or rank vegetation. Any appeal of the notice must be made within ten calendar days of the date of the removal notice or statement of costs.
Following discussion, George Schenkel made the motion to close the public hearing, Sue Williams seconded the motion, and the motion passed. George Schenkel then made the motion to pass the second reading, Sue Williams seconded, and the motion passed.
ORDINANCE 2009-2. AN ORDINANCE DEFINING THE PENALTY FOR FAILING TO CONNECT TO THE CLEAR LAKE SEWERAGE SYSTEM. SECOND READING. This ordinance defines the penalty for failing to connect to the Clear Lake Sewerage System.
George Schenkel made the motion to close the public meeting and open a public
hearing. Sue Williams seconded the motion and the motion passed. The procedure
is defined by Indiana Code. Bob Lewis read the highlights of the code. George

NEW BUSINESS
1. Drainage tile bid was in the superintendent report.
2. 2009 Garbage contract. George Schenkel made the motion to
approve the garbage contract, Larry Armstrong seconded, and the motion passed.
3. Transfer of Town Property to Conservancy. Flora Holmes Area –
transfer to CLTLC. Hanna Preserve needs study.
RESOLUTION 1-2009. RESOLUTION REGARDING
TRANSFER OF REAL ESTATE TO THE CLEAR LAKE TOWNSHIP LAND CONSERVANCY, INC. George
Schenkel made the motion to transfer, Sue Williams seconded, and the motion
passed.
4. Update on Unified Development Ordinances.
5. Red Cross. First aid training. Bob Lewis will contact the Red
Cross to schedule a date for training.
6. Update on Phosphorus Free Clear Lake. Mary Jo Fitzenrider
discussed an upcoming meeting with the state chemist. This will take place
during the September – October period.
7. Bush hog quotes. As noted in the Town Superintendent report, the
Council approved the purchase of a tractor from the Purdy Tractor & Equipment.
The next Council meeting will be held on May 8. At 9:05 p.m., Sue
Williams made the motion to adjourn, George Schenkel seconded the motion, and
the motion passed.
