MINUTES OF THE MAY 11, 2009 COUNCIL MEETING
The meeting of the Town Council was called to order at 7 p.m. by Bob Lewis.
Present were Council members George Schenkel, Sue Williams and Barry Worl. Also
present were Neal Blythe, Town Attorney, Bob Hull, Bruce Snyder and Ginny Nye.
Twenty-two people signed the guest register.
Minutes of the April 30 Town Council meeting (with corrections) were read and
approved by the Council, upon the motion to approve by Barry Worl, and second by
Sue Williams.
Financial reports included the Voucher Register with:
General Funds $66,425.17
Sewer Fund $15,283.52
Garbage Fund $ 9,232.01
Total $90,940.70.
Warrants to be approved totaled $77,315.82 for the month of May.
REPORTS
There was no Marshal Report. Barry Worl gave the Fire Department Report. There
were 31 total calls, none in Clear Lake.
Bruce Snyder reported two Improvement Location Permits were issued in March and
BZA Appeals meeting for April 20 were cancelled. No variance applications were
filed.
Bob Hull reported that the award to install a catch basin along Lake Drive at
the property line between 388 and 390 Lake Drive made at the last Council
meeting will start this week. The Bush Hog has been delivered and he will try it
out on Tuesday. He is also planning street areas to be paved this year.
UNFINISHED BUSINESS
1. Neal Blythe gave the Update on litigation. The longstanding
helicopter dispute has been given an award good for the town.
2. ORDINANCE 2009-1. An Ordinance Regarding the Removal of Weeds
and Other Rank Vegetation. Third Reading. Bob Lewis read the summary of the
ordinance. George Schenkel made the motion to approve the third reading. Sue
Williams seconded, and the motion passed.
3. ORDINANCE 2009-2. AN ORDINANCE DEFINING THE PENALTY FOR FAILING
TO CONNECT TO THE CLEAR LAKE SEWAGE SYSTEM. Third Reading. This ordinance
defines the penalty for failing to connect to the Clear Lake Sewerage System, a
fine of $500/day. Sue Williams made the motion to approve the third reading,
Barry Worl seconded the motion, and the motion passed.
Certified notices of the ordinance will be
published in the Herald Republican.
4. Resolution Authorizes Transfer of Property to Clear Lake
Conservancy. This resolution authorizes the President of the Clear Lake Town
Council to complete the necessary due diligence and execute documents to
transfer a parcel of real estate owned by the Town of Clear Lake to the Clear
Lake Land Conservancy, Inc. The full Council was in favor of the transfer.
5. Red Cross-Free CPR/First-Aid Training – June 6 at the Town Hall,
8 AM – 4 PM. Sue Williams made the announcement.
NEW BUSINESS
1. ORDINANCE 2009-3. AN ORDINANCE AMENDING ORDINANCE 251 TO
INCREASE THE CHARGE FOR COLLECTION OF GARBAGE AND REFUSE.
First Reading. George Schenkel made the motion to pass the second reading, Sue
Williams seconded and the motion passed.
2. ORDINANCE NO. 2009-4. AN ORDINANCE REPEALING ALL PREVIOUS ZONING
AND SUBDIVISION CONTROL ORDINANCES AND MAPS AND ADOPTING A REPLACEMENT ZONING
AND SUBDIVISION CONTROL ORDINANCE AND ALSO ADOPTING A COMPLETE REPLACEMENT
ZONING MAP. Summary: This ordinance repeals all previous zoning and subdivision
control ordinances and maps and adopts a replacement zoning and subdivision
control ordinance, hereinafter known as the Unified Development Ordinance, and
also adopts a complete replacement zoning map. Bob Lewis read the Ordinance
Summary. George Schenkel made the motion to approve the first reading or
Ordinance No. 2009-4, Sue Williams seconded the motion and the motion passed. A
public hearing is scheduled in June.
3. Public Beach Meeting. George Schenkel summarized the meeting
that the Council had on May 4 with the Steuben County Board of Commissioners,
who are interested in selling the public beach. No decision has been made. The
County would like to see the town purchase the property and keep it a public
beach, however, the County understands that the purchaser can do with the
property as they see fit, within zoning constraints.
4. Bob Lewis gave an update on the insurance that the town carries
with Wells Fargo Insurance Services.
5. Clear Lake Association letter. The Association Board of
Directors has supported the town in the past and would like to be informed about
current needs the town may have.
The Council adjourned at 8:15 p.m. upon a motion by Barry Worl and second by
George Schenkel.
