Minutes Of The November 9, 2009 Town Council Meeting
The regular meeting of the Town Council of Clear Lake, Indiana was held at the
town hall on Monday, November 9th at 7:00 pm. Present were Council Members Bob
Lewis, George Schenkel, Sue Williams, Barry Worl and Alan Korte. Also present
were Town Manager Bob Hull, Zoning Administrator, Bruce Snyder and Town
Attorney, Neal Blythe. There were 15 citizens who signed the guest register.
President Bob Lewis called the meeting to order with the Pledge of Allegiance.
Minutes of the October 12th meeting were read. Bob Lewis asked for a motion to
approve as read. The motion was made by George Schenkel, seconded by Sue
Williams, all in favor and the motion passed.
Financial report was given by the Clerk-Treasurer for the month of October
stating beginning and ending balances for cash and investments, receipts and
disbursements for the General Fund, Garbage Fund and Sewer Fund. This report is
attached to the minutes.
Vouchers for the month of October were as follows for:
General Fund $11,056.96
Garbage Fund 5,294.25
Sewer Fund 33,976.59
Total Amount of Vouchers $50,327.80
Warrants to be approved totaled $11,052.61
A motion was made to approve the vouchers and warrants to be paid by Barry Worl,
seconded by Sue Williams, all in favor and the motion passed.
REPORTS:
MARSHAL’S AND FIRE DEPARTMENT: Barry Worl reported for the
Marshal that there was 1 assist for the Fremont PD, 4 assists for the Sheriff’s
Dept., 2 background checks, 1 handgun permit, 1 unsecured property, 2 VIN/HIN
checks and 2 property damage vehicle crashes. The Marshal is still working with
NIXEL to be able to post information to their website for the town.
Marshal Gonya had applied for a grant from Canon
through the National Center for Missing and Exploited Children some time ago.
Notice was received last week that they would be shipping the department a new
digital camcorder and photo printer at no cost to the town. The camera and
printer were delivered today.
The new patrol vehicle has been ordered.
Joe Patterson has been hired as the new Marshal of
Fremont.
Barry also reported that the Fremont Fire Department
made 32 calls for the month of October, none of them in the Town of Clear Lake
and 2 medic assists in Clear Lake Twp.
ZONING ADMINISTRATOR:
Bruce Snyder reported no Improvement Location Permits
for the month of October. It was determined that no Improvement Location Permits
were required to repair the existing retaining wall at 800 Lake Drive.
Board of Zoning Appeals meeting that was scheduled for
October 19th was rescheduled for November 3rd. The 2 variance applications will
be heard on that date.
During the month of October 7 inquires/complaints were
investigated of which 5 have been resolved and 2 are in the process of being
resolved.
TOWN MANAGER:
Bob Hull reported that there were 16-location requests,
28-pumps replaced or repaired, 2-service calls and the average daily flow was
37,616 gallons. M & C Trenching as completed the inspection of all grinders in
the system and found 59 out of 386 pumps have bearings that need to be replace.
With the help of Frank Nye, they are working on a system to track the
maintenance of all pumps.
Brooks’ construction has finished the asphalt
application for the fall and Bob is working to build up the edges with gravel
and limestone.
M & C Trenching has installed a curb on the south side
of Elm Street to help with the wash-out problem of limestone and Alan Korte has
removed and installed a new curb at 950 Lake Drive.
The snow plow has bee repaired and the sander is next.
The sand/salt barn started on November 5th and should be completed by early
December.
Bob is also working on maps for the 2010 Census.
BILLING CLERK:
GARBAGE ACCOUNTS: Final notices have been sent for all
past due garbage statements. Small Claims will be filed by November 17th for
those home owners with unpaid balances. Past due amounts through today total
$826.24.
SEWER ACCOUNTS: Additional property owners have signed
up for auto draw with the authorization form included with their coupon
booklets. Letters have been sent to property owners with auto draw notifying
them of the rate change on hook-ups with ½ rates because they do not receive
coupon booklets. Past due amounts through today total $17,708.26.
UNFINISHED BUSINESS:
LITIGATION:
Neal Blythe reported on the fence case. There will be a
pre-trial meeting soon to decide on a date for the December hearing.
Deck hearing set, no hearing set for the summery
judgment.
In the McElhinney litigation it was determined that the
town was not involved.
ORDINANCE 2009-6: 3RD READING – AN ORDINANCE REGULATING THE USE AND
REGISTRATION OF GOLF CARTS WITHIN THE TOWN OF CLEAR LAKE
A motion was made to suspend the rules and read by

ORDINANCE 2009-7: 3RD READING – AN ORDINANCE ESTABLISHING A LOCAL
OPTION INCOME TAX FUND FOR THE TOWN OF CLEAR LAKE.
A motion was made to suspend the rules and read by

motion passed.

ORDINANCE 2009-8: 3RD READING – AN ORDINANCE SETTING SALARIES AND
WAGES OF THE OFFICERS AND EMPLOYEES FOR THE TOWN OF CLEAR LAKE, INDIANA FOR THE
YEAR 2010.
A motion was made to suspend the rules and read by

RECEIVE DONATIONS FROM THE CLEAR LAKE ASSOCIATION, INC.

ORDIANCE 2009-11: 1ST READING – AN ORDINANCE ESTABLISHING LOCAL
PLANNING AND ZONING FEES PURSUANT TO THE UNIFIED DEVELOPMENT ORDIANANCE.
Bob Lewis read Ordinance 2009-11 in its entirety and
asked for a motion to pass Ordinance 2009-11 on the first reading. A motion was
made by George Schenkel, seconded by Sue Williams, all in favor and the motion
passed.
ORDINANCE 2009-10: 1ST READING – AN ORDINANCE AMENDING THE CLEAR
LAKE SEWER ORDINANCES
Bob Lewis read Ordinance 2009-10 in its entirety and
asked for a motion to pass Ordinance 2009-10 on the first reading. A motion was
made by Alan Korte, seconded by George Schenkel, all in favor and the motion
passed.
