MEETING MINUTES

Minutes Of The July 12, 2010 Town Council Meeting

The regular meeting of the Town Council of Clear Lake, Indiana was held at the town hall on Monday, July 12, 2010 at 7:00 p.m. Present were Council Members, Bob Lewis, George Schenkel, Sue Williams and Alan Korte. Also present were Town Superintendent Bob Hull, also serving as Temporary Zoning Administrator and Town Attorney Neal Blythe.

President, Bob Lewis called the meeting to order at 7:00 p.m. with those in attendance standing to recite the Pledge of Allegiance.

Bob Lewis asked for any additions or corrections to the June 14th minutes. There was a change in the # on Ordinance 2010-06 it should be 2010-04, Bob asked for a motion to accept as corrected. George Schenkel made the motion to accept the minutes as presented, Alan Korte seconded, all in favor and the motion passed.

The Clerk/Treasurer reported that there would be no Treasurer’s Report for the month of June and proceeded with the Voucher Register for the following funds from June 1st -30th:

Bob Lewis asked for a motion to approve the Voucher Register in addition to the warrants to be paid in June. Sue Williams made the motion to approve the voucher register and warrants to be paid, seconded by George Schenkel, all in favor and the motion passed.

REPORTS

Marshal’s Report – George Schenkel reported for the Marshal that they have been busy issuing golf cart permits, with a total of 45 registrations to date.

The 4th of July weekend went fairly smooth except for a late night/early morning break in of several vehicles on July 4th & 5th. The marshal reminds us to be sure to lock our vehicles and remove valuable items from plain view. Report any suspicious activity by calling 911.

In June the police department responded to the following complaints in June:

    1 criminal mischief
    1 suspicious person
    4 assist’s for the Sheriff’s Department
    2 background checks
    3 VIN/HIN checks
    1 assist for DNR
    Numerous golf cart inspections

Fire Department – George Schenkel reported for the fire marshal that there were 55 calls for the month of May with one call to the Town of Clear Lake and one in Clear Lake Twp.

Building & Zoning Report – Bob Hull thanked Chris Folland, Emma Brown, Bill Geiger and Bob Lewis for assisting him with his temporary duties. There were 4 Improvement Location Permits issued for the month of June.

Sewer Department – Bob Hull reported during the month of June there were 11 locates, 9 alarm calls, 8 pumps replaced or repaired, and the average flow was 52,933 gallons per day.
The system worked well over the holiday week-end and 6 grinder pumps were replaced on Sunday and Monday.

Street Department – Bob Hull reported that the engineers have staked the project on the west side of the lake for 2010 and are working on the final design. The project should be ready for bid by the next Council Meeting.

The culvert pipe under the road at 546 is unplugged and we will be installing a screening devise to prevent this happening in the future.

The town attorney, Neal Blythe is working with a title company to determine ownership of the road in Point Park Addition.

A property owner on Round Lake failed to mow his lot after a written notice was sent. Bob Hull has mowed the property and the Billing Clerk has sent a bill for the service.

Billing Clerk – Bob Hull reported for Laura that she will be going to Small Claims on July 15th for Trash collection and if the property owner fails to appear a bench warrant will be ordered.

Sewer collections are going smoothly. The town received sewer lien payments on three liens and a partial payment on a fourth. Liens will be filed again on two property owners this week making a total of five active liens.

UNFINISHED BUSINESS

    1. Private road issue – Neal has retained Guardian Title Company to determine if the drive from #420 - #462 is a private or public road.

There has been one reply of the three lawsuits that have been served compelling property owners to hook-up to the town’s sewer system.

    2. ORDINANCE 2010-04: 3RD READING AN ORDINANCE AMENDING CLEAR LAKE ORDINANCE 2009-06 REGULATING THE USE OF GOLF CARTS.

Bob Lewis read the ordinance in its entirety and asked for a motion to approve Ordinance 2010-04 on the third reading. Alan Korte made a motion to accept Ordinance 2010-04 amending the Clear Lake Ordinance 2009-06 regulating the use of golf carts, Sue Williams seconded, all in favor and the motion passed.

NEW BUSINESS

    1. Resolution #01-2010 – A RESOLUTION REGARDING TRANSFER OF REAL ESTATE TO THE CLEAR LAKE TOWNSHIP LAND CONSERVANCY, INC.

Bob Lewis read the resolution in its entirety and asked for a motion to accept the resolution as presented and to transfer the described real estate to the Conservancy. Alan Korte made the motion to accept Resolution #01 – 2010 as presented, seconded by Sue Williams, all in favor and the motion passed.

    2. Resolution #02 – 2010 – A RESOLUTION REGARDING TRANSFER OF REAL ESTATE TO THE CLEAR LAKE TOWNSHIP LAND CONSERVANCY, INC.

Bob Lewis read the resolution in its entirety and asked for a motion to accept the resolution as presented and to transfer the described real estate to the Conservancy. George Schenkel made the motion to accept Resolution #02 – 2010 as presented, seconded by Alan Korte, all in favor and the motion passed.

    3. Fire Protection Agreement with Fremont – George Schenkel reported that the fire contract for 2011 with the Town of Fremont will increase 5% or $1,135 to $23,835. After discussing the contract, Bob Lewis asked for a motion to accept the Fire Contract for 2011 with the Town of Fremont. Sue Williams made the motion to accept the 2011 Fire Protection Contract with the Town of Fremont, all in favor and the motion passed.

    4. Heritage Committee Report – Bonnie Brown. Bonnie reported that of the 1,000 books, plus the 10% overrun, 600 books have been delivered for pre-sales or new sales. Bonnie also reported that the newspaper story coming out on Wednesday would list the locations in the community where the history books can be purchased.

    5. Water Quality Committee Report – Annie Skinner, this month is going to be education month for the Water Quality committee. Watch the bulletin board for Knee-hi Naturalists activities, every Wednesday of July. The Clear Lake Association annual meeting will be on the 17th and there will be a lot of information on water quality. The Clear Lake Land Conservancy Gala on the 24th at the Yacht Club with a presentation by the Executive Director of ACRES Land Trust, Jason Kissel.

    6. Tornado Sirens – we are waiting on a quote from Torg Electric on the cost of repairing the Tornado Siren.

    7. Staggered Council Seats – continuing to look into doing this during a Federal election.

Bob Lewis asked for a motion to adjourn the meeting at 7:45 p.m. A motion was made by Alan Korte adjourn the meeting, seconded by George Schenkel, all in favor and the motion passed.

Comments from Attendees: Emma Brown, #432 Lake Drive asked about the Town’s defibrillator. Bob Lewis will have the Town Marshal, John Gonya look into this matter.
